| 摘 要： | 我国法律法规对夫妻之间借贷没有禁止性规定,夫妻一方从夫妻共同财产中的借款行为符合法律规定。在司法实践中,正确认定借款来源是正确适用法律的前提,正确界定借款用途是正确适用法律的关键。

| Abstract: | There is no prohibitive provisions for borrowing and lending between husband and wife in the laws and regulations of our country. A spouse borrowing from the marital property is regarded as legal. In judicial practice, the prerequisite of correct application of law is to confirm the loan source and define correctly the use of the loan. |
