| 摘 要： | 为亲友非法牟利罪是刑法修订时专门针对国有公司、企业、事业单位工作人员利用职务便利,进行背职经营而规定的一种新的犯罪行为。但在法律上如何界定国有公司、企业、事业单位,如何界定“亲友”的范围,真正做到规范国有公司、企业、事业单位的管理,防止国有资产流失,是值得探讨的。

| Abstract: | The crime of gaining profits for the relatives and friends illegally is a new kind of criminal offence stipulated when the criminal law was revised, which is specially to the staff members who utilize the convenience of the post in government-owned corporation, enterprise, or institution to carry duties to manage. This paper discusses the problems of how to determine a state-run corporation, an enterprise or an institution lawfully, and how to determine the range of "relatives and friends" so as to realize the aim of standardizing the management of government owned corporation, enterprise and institution, and to prevent the state-run losses of assets, etc. |
