| 摘 要： | 伴随人们法制观念和法律意识的日渐增强 ,通过法律途径解决民事争议理当成为多数人的选择。但通过调查我们发现 ,仍然有大量的民事争议未能进入诉讼程序。通过一定范围的调查分析 ,从当事人、法官素质、诉讼模式、司法体制及立法缺陷等方面分析了这一现象存在的原因 ,指出了其不良影响 ,并对此提出了相应的对策。

| Abstract: | Turning to law for civil disputes has become the choice of majority, yet quite some cases failed to enter lawsuit procedure. This paper analyzes the causes and the consequences, and offers some countermeasures, on the basis of its investigation of the concerned parties, the judge, legal system, and some flaws in law making. |
