| 摘 要： | 不同学者对思想与表达二分法原则有着不同的解读，但这些解读的结论都不是普遍适用的。在制定法背景下，知识产权政策应该成为解决这一问题的关键考虑因素，不同国家的立法机关应该根据本国的知识产权政策定位，并对这一原则进行解读和重构。

| Abstract: | There are some different interpretations about the idea-expression dichotomy among different scholars,but these interpretations do not possess universal significance.In the law-making background,the intellectual property policy should be the key factor to be taken into considerations to solve this problem.The legislatures in different countries should decide their own right niche according to their own intellectual property policy and then interpret and reconstruct this principle. |
