生物经济发展及其法律选择

针对生物经济发展的法律选择,学界存在不同看法,乐观说认为法律应为生物经济的发展扫清障碍,而谨慎说则认为法律对生物经济的发展应加以限制。生物经济发展具有公益性但同时又具有高风险性。生物经济发展的法律选择应立足于生物经济自身的两面性。为此,法律应当同时高举保护与管制两把利剑,维护生物经济的健康发展。

The development of bio - economy and its legal alternative

There are two opinions on the legal alternative against bio-economy,the one of which is optimism which holds law should clear off the obstacles of the development of bio-economy while the other is cautioners who thinks law should restrict the development of bio-economy.The development of bio-economy is of public interest while it also brings about high risk to human being.The alternative of law should stand on the character of bio-economy,which means the law should hold two swords against the development of bio-economy,the one of which is protection and the other is supervision,to safeguard the development of bio-economy healthily.
