| 摘 要： | 法院调解是民事案件审理中的重要制度,在我国民事诉讼中发挥了积极的作用,但在新的形势下,其存在的问题亦日益明显。本文从分析调解制度的涵义及价值取向入手,在考察美德两国的民事诉讼和解制度后,提出了完善我国法院调解制度的几点建议。

| Abstract: | The court mediation is a significant system in civil action which plays a positive role in it. But under the new circumstance; some problems of mediation are more and more obvious. After investigating the mediation system in civil action of America and German and analyzing the conception and value orientation of mediation system, this thesis give us several suggestion on the mediation systems perfection in China. |
