| 摘 要： | 法律移植必须要有其适合的土壤,必须以中国几千年的文化传统为基点,有选择地将外国法律的先进理念纳入我国现代法治的进程中,使之相互吸收、相互融合,从而形成适合中国的现代法律文化。

| Abstract: | There must be a soil fit for profitably sharing laws from foreign countries. The Chinese cultural traditions of thousands of years must be taken as a basic point in profitably sharing foreign laws. It is imperative to bring the foreign progressive ideas into our country's modern legal system on a selective basis in order to absorb the best of both Chinese and foreign laws, compromise the merits of both Chinese and foreign laws and establish a modern law culture fit for China. |
