| 摘 要： | 正常操作取款机.却因取款机故障而获利,在只需支付1元对价即可获1000元人民币的诱惑下,犯罪嫌疑人许霆取款170余次.获利17.5万元.一审以盗窃罪时其提起公诉,判决后却引发空前争论,刑民之争、罪名之争、刑罚之争.各持己见.从法律角度来解析该案.了解相关法律规定,直面现行法律缺漏,评述建议,用个案反思方式推动法制建设进程.

| Abstract: | As the failure of the ATM, Xuting get 1000 yuan by 1 yuan's payment. In that temptation, he drew over 170 times, gained 175 thousands yuan. After the first instance, larceny' judgment,aroused a firework. The thesis is based the view of law to analyses this case, propelling the rule of law by single case research. |
