我国环境权概念的反思与重构

在构建我国环境权概念时，其内涵不应当囊括自然资源开发和利用的权利，程序性的环境权利应排除在环境权之外，要注意环境权只是环境权利的一部分，而且不应该把环境权主体扩展到自然体。环境权是指环境法规定的公民、法人和其他组织对其生存环境所享有适宜的生态环境的权利，包括清洁空气权、清洁水权、清洁产品权、环境审美权、环境文化权、合适的日照权、环境安宁权和户外休闲权等。

Reflection and Reconstruction of the Concept of Environmental Right of China

Constructing the concept of environment power in our country,its connotation shouldn't include the development and use right of the natural resource.The procedural environment right should remove outside the environment power.We must pay attention that the environment power is only a part of environment right,it should not be expanded from the environment power main body to the natural body.The environment power refers to the powers of the citizen,the legal person and other organization enjoying their survival environment are suitable in the environment law,including the clean air power,the clean water power,the clean product power,the environment esthetic power,the environment culture power,the appropriate sunshine power,the environment peaceful power and the outdoors leisure power and so on.
