| 摘 要： | 本文从保安处分制度的理论发展开始谈起，主要介绍了西方保安处分制度的理论之历史沿革，各个时期各个学派代表人物的主要学术观点，及其中的一些立法和司法实践。同时又对目前欧陆国家关于保安处分制度的现状予以相应的介绍。最后对我国建立保安处分制度从立法理由，立法例，立法结构到建立相应的种类都做了一番有建设性的探讨。
