| 摘 要： | 林权是一项集合性权利，在性质上是一种私权。林权改革就是在充分考虑林权客体特殊性的基础上，进一步明晰不同主体所拥有的林权，按照市场经济规律的要求促进林权流转，并建立生态效益补偿机制。我国目前的林权改革就是沿着这一方向进行的。林权改革及其成果需要立法巩固，林权立法就是在尊重生态效益优先和市场经济规律的基础上，对林权进行用益物权化改造，使林权成为一种新型用益物权。

| Abstract: | Forest property is a combination of rights, belonging to private sector. Forest property reform is to clear rights of different owners, to boost the rights of transfer according to market regulation and establish ecological welfare and compensation system with considering the characters of forest property＇s object. Our present reform is under this way. Safeguarding its results should be done by legislation. The forest property legislation has to make the property utilization and create a new kind of usage right with the priority of ecological welfare compensation and governing of market regulation. |
