| 摘 要： | 大学生受教育权的充分实现和保护要求高校建立正当的管理程序。学生受教育权受到侵害后的法律保护不仅要有事前救济,而且也应有事后救济。校内听证制度和完善的申诉制度是保证学生参与权实现、进行校内救济的有效渠道。有限的司法审查介入高校内部管理秩序是大学生受教育权利保护的最终途径。

| Abstract: | :The full realization and protection of university students' education right requires university set up proper administration procedures. Students' education right is not merely relieved by the legal protection after encroaching on, and should be relieve afterwards. School hearing system and perfect appeal system are two effective channels to guarantee students' right to participate in and relieve. Limited administration of justice examining involved inside the university is the final way that the protects university students' right to receive education. |
