劳动法适用中劳动者身份的识别问题

摘    要:劳动法的适用需要首先对劳动者的身份进行识别。在劳动者的身份得到确定前提下,才能根据劳动法确定当事人的权利、义务和责任。在具体实践中,如果用人单位与某个人之间签订了正式的劳动合同,可以直接根据劳动合同来认定劳动者。在不存在劳动合同,或合同的性质难以确定时,应当首先根据案情显示的情况,采用其他身份识别标准对劳动者的身份进行识别,并在此基础上,按照适用于当事人的法律确定当事人的权利、义务和责任。

Abstract:In the application of Labor Law, identities of laborers should be first identified. Only identities of laborers are established, rights, obligations and responsibilities of litigants can be defined according to Labor Law. This article believes that if there are formal labor contracts between laborers and management, identities of laborers can be established by contracts. If not, others standards should be applied according to the real situation of cases, and on this basis, litigants' rights, obligations and responsibilities are defined.
