| 摘 要： | 随着改革开放的深入和中国成功加入WTO，“与国际惯例接轨”、“按国际惯例办事”已迫在眉睫。在实践中，人们应认清国际惯例含义，注意国际惯例的效力及与国际惯例接轨等法律问题，强调“与国际惯例接轨”不能凌驾于法律之上，应使之与“有法必依”达到统一。

| Abstract: | Along with the deepening of reform and China's entry to WTO, linking up with international convention becomes an urgent task. However, it is important to understand the real meaning of international convention, its application and relevant legal issues. Linking up with international convention should not exceed the right endorsed by law, and should be unified with the Law system available. |
