中国影响汽车零部件措施案与WTO国民待遇原则

国民待遇原则是WTO法律框架的基石之一，中国汽车零部件案所有投诉方都指控中国措施违反了GATT第3条规定，导致进口汽车零部件在中国境内享受的待遇低于同类国产零部件的待遇。专家组采纳了投诉方观点，认定中国措施不符合GATT第3条第2款和GATT第3条第4款。要求中国对相关措施进行修改。中国对专家组报告不服已经向上诉机构提起上诉。目前此案仍在审理中。

The Case of China-measures Affecting Imports of Automobile Parts and the Principle of National Treatment Under WTO

The principle of national treatment is one of WTO legal framework cornerstones. All the parties complaining the ease argue that the Chinese measures are against the third item of GATT which accord less favorable treatment to imported auto parts than to domestic auto parts. Their arguments are adopted by the specialists with the opinion that Chinese measures disagree on the second and fourth item of the third rule. China refuses to accept the report of panel and has appealed to the Appellate Body. Now the case is still pending.
