试论WTO争端解决机制与国家主权的关系

美国“1994年主权大辩论”及其后续影响促使我们思考WTO争端解决机制与国家主权的关系。诚然，WTO争端解决机制对国家主权造成了一定的冲击，但是它没有，也不可能从根本上改变国家主权，不可能动摇国家主权原则在国际法中的基础地位。两关系之争也表明：国家主权在新时期有新的表现形式，但不可能“谈化”或“消亡”；在相当长的时间内，国际组织与民族国家在主权的问题上的“斗争与较量”还将持续下去。

On the Relation between Mechanism of Dispute Settlement and National Sovereignty

1994 great debate on sovereignty in the U. S and its follow-up effect impel us to ponder over the relation between the mechanism of dispute settlement in the WTO and national sovereignty. Truly, the mechanism of dispute settlemant in the WTO will give national sovereignty a certain shock but it will never alter national sovereignty and it is impossible to shake the fundamental status of the principle of national sovereignty in the international law. As also indicated by the debate on their relation, national sovereignty has new form of expression in the new period, but it is impossible to be faded out or extinct; " struggle and contest of international organization and national states on the issue of sovereignty will last for a period of considerable length.
