| 摘 要： | 本文就新中国历部宪法和宪法性文件中所规定的农村土地所有制的产生原因及变化过程作出了回顾和分析，指出现任宪法规定的农村集体土地所有制在理论和实践中面临的困惑，认为根据所有制形式要符合社会生产力发展的基本原理，在中国经历了20多年的改革开放之后，现行宪法规定的农村土地所有制也应“与时俱进”。

| Abstract: | This paper, looking back and analyzing the producing reason and ongoing process of the system of land ownership in countrysides according to Chinese constitution and correesponding documents, points out the difficulties met both in theory and practice of the current collective system of land ownership in countrysides. It thinks that according to the constitution, the current system should be updated. |
