宋代流刑特点考论

宋代流刑虽然在刑名和内容上均沿袭了唐律中的相关内容,但随着社会的发展和法律制度的不断完备,流刑在这一时期也发生了一些重大变革,呈现出许多新的特点,如:惩罚方式由单纯的流远变为流、杖、刺、徒数刑并用;适用犯罪从犯罪性质、犯罪情节特别严重的十恶重罪扩大为一般性犯罪;犯罪适用对象也已不局限于死罪贷命者,还包括一些犯杂罪者甚至是轻微犯罪者;流放期限也从有期变为终生服役等.
