论秦汉政治文化整合过程中法家思想的变异

在秦汉政治文化整合过程中,法家思想大都得以落实。然而,在此过程中,法家思想发生了变异,集中体现在法家真精神的遗失。法家法的精义、变革现实的精神、法律面前人人平等的精神、贵公抑私精神及法、术、势结合的理论体系等发生了变异,这些变异使得法家后来成为封建专制政治的帮凶。今天,我们建设社会主义法治需要剥离和清除这些消极的东西,以为我们的社会确定一个良好的文化基础。
