论父母子女权利义务的割断

父母子女的权利和义务是基于特定的原因而形成的法律关系 ,在通常情况下 ,二者的权利和义务相互依存 ,不能发生阻却。但在未成年人合法权益遭到侵害并达到一定程度时 ,可以考虑二者的割断问题 ,这样可以警示为人之父母 :可期待的赡养扶助的权利的实现 ,必须以履行对子女的抚养教育义务为先决条件。
