摘    要:预告登记制度对应于本登记,是为补充不动产登记的公信力的缺陷而设立的一种制度。我国目前在商品房预售领域主要实行预售商品房合同登记备案制度,这一制度属于行政管理,存在诸多不完善之处。为保护商品房预购人的合法权益,应建立预告登记制度。我国应在借鉴国外以及台海地区经验的基础上,选择适用于本国国情的制度设计,建立完善的商品房预告登记制度。

Abstract:The announcing in advance registration system is the counterpart of origin registration,which is established for compensating for the lack of public confidence of real estate.The present system has many short comings.In order to protect the lawtul right of commercial honsing buyer,our country shonld use the experiewces of foreign countries aswell as the Taiwnn Strait Region,and choose the system design suitable for our countrg's conditions so as to establish pertect commercial housing announcing in advance registration system.
