| 摘 要： | 随着社会经济生活的发展、科技的日新月异及新兴载体的出现,因遗嘱形式问题及不同遗嘱形式之间效力问题引发的纠纷日渐增多,我国《继承法》关于遗嘱形式的规定已经无法满足实际生活的需要,难以解决司法实践中出现的诸多问题。有鉴于此,我国宜参照其他国家的立法例,考量我国的实际情形,完善我国有关遗嘱形式的立法规定。

| Abstract: | With the development of economic life,scientific technology and new carriers,disputes caused by will forms and the effect of the different will forms have risen.The existing regulations in Law of Succession are unable to meet the needs,difficult to solve many problems in judicial practice.For this reason,China should take legislations of other countries into account,pay much attention to China’s actual conditions,and improve legislation on will forms. |
