| 摘 要： | 由于我国调整油污损害的专门法律的缺失,司法实践中船舶碰撞造成油污损害时,如何确定赔偿责任分歧很大.分清碰撞法律关系和油污法律关系是解决问题的关键,而制定专门法律明确之并配套以国内油轮的强制责任保险制度和国内油污损害赔偿基金制度是最终的途径.

| Abstract: | As a result of the lack of oil pollution act in China,there are some divergence on how to define the liability of oil pollution caused by ship collision in the judicial practice.The key to resolve the problem is to distinguish between the legal relation of the collision and that of the oil pollution,while the final way to resolve it is to make the oil pollution act and to coordinate some measures. |
