试析吧国公堂的盟神审判

Analysis of the Mengshen Trial in the Chinese Council of Batavia

Swear by God, which is a kind of trial by the god, as a means to solve many kinds of conflicts and disputing within the mass, and is adopted familiarly in the court either by the defendant or the accuser. It was promulgated into Batavia and adopted usually by the Chinese emigrate to South- east Asia. The Chinese Council or Gongtang of Batavia embodies many cases about it. This article explores the existing background of the trial pattern of Batavia Chinese from their belief, the policies of the Dutch colonial government and the influences from China at that time. It also analyzes the characteristics and the historical effects of the trail pattern according to the cases in The Chinese Council or Gongtang of Batavia.
