| 摘 要： | 廷杖在明代大行其道，杀人至惨而不丽于法，是有明一代著名的酷刑，是明朝统治者实行极端高压恐怖的统治模式之一。廷杖反映了明朝皇权与士大夫之间的对立，是在明朝重典治吏的立法思想下形成的一项独特的酷刑，它的泛滥与明朝文官制度的不完善密切相关，同时加剧了统治阶级内部的离心倾向，对明朝产生了极其恶劣的影响。

| Abstract: | Court Beating was popular in Ming Dynasty. It was not included in law due to its cruelty. As a notorious cruel torture, it was a tool for the Ming Rulers to perform an extreme ter- roristic administration. Court Beating reflects the conflicts between the royal power and the no- bles. It was born in the condition of managing the officials with laws. Its popularity was due to the incomplete civil service system. It made the inner conflicts worse and thus led to a very bad influence. |
