我国僧侣遗产继承法律问题研究简

僧侣遗产继承存在法律上的空白，导致僧侣遗产继承时面临无法可依的尴尬局面。文章通过对佛教僧侣财产来源进行分析，区分遗产类型，甄别继承主体，旨在充分研究法律与佛教伦理的基础上探讨僧侣遗产继承法律问题，进而整理、归纳解决僧侣遗产继承纠纷的路径。消除宗教习惯与法律规定之间的冲突，理顺僧俗两界在僧侣遗产继承处理中的关系，同时，立法机关应当制定相关法律规范予以平衡各主体之间的利益，这才是解决纠纷的主要路径。

The Legal Issues on Monk Legacies Inheritance in China

The inadequacy of the legal items concerning the monk legacies inheritance leads to the inefficiency in the related cases. By analyzing the monks＇ property source, the legacies are classified and the subjects are defined in order to discuss the legal issue considering legal research and Buddhist Ethics. Hopefully, an efficient legal approach to this conflict would be worked out. It is suggested that the conflicts between religious convention and law should be solved, the relation between the religious and secular ideas and practice should be dealt with, and laws that would balance the benefits of parties should should be established.
