论明清立法语体的规范化特征

立法语体的规范化是指语体风格的平正、明决、老道、典雅。作为立法语体,成熟期是隋唐,而真正规范化的当属明清。《大明律》的言语表意非常明晰确定,也很显露,无隐喻无象征,这正是立法语体规范化的属性之一。《大清律例》语体风格虽与明律比较相似,但也有自己的特性:既有《大明律》的洁净利落、简易平实的特点,也有自己雅致蕴藉的个性,真正成就了非常规范的立法语体。
