虚拟办公室作为新生事物,在实践运作中利弊都很明显,学术界对其存废问题存在一定争议。分析其利弊,我们发现虚拟办公室与现行企业住所、经营场所注册登记及变更登记制度之间存在一定的法律冲突。因此,如果虚拟办公室要想继续存在、发展的话,那么必须对其进行以下改革和规制:改革现行的公司住所登记制度,明确规定经营者的法律义务,明确规定虚拟办公室使用者的法律义务。

Some Legal Questions on the Virtual Office

Virtual office, as a new thing, has obvious advantages and disadvantages in the practice. Therei＇e controversy on using or a- bolishing it. By analysing its pros and cons, we have found out that there are some conflicts between the virtual office and the commer- cial registration system of law. For a better existence and development of the virtual office, we should carry forward the following re- forms, that is, to reform the current commercial registration system, make regulation on the legal obligation of both the operator and the user of virtual office.
