国际公约与我国《海商法》对提单之调整

摘    要:提单是国际海上货物运输中最重要的单据。在履行提单的权利义务方面 ,主要的法律问题集中在承运人的责任方面。从本世纪 2 0年代到现在 ,承运人的责任制度发生过并正在发生着重大变化 ,而这些发展变化主要是通过《海牙规则》、《维斯比规则》与《汉堡规则》三个国际公约表现出来的。我国不是三大国际公约的缔约国 ,但我国的《海商法》吸收并反映了公约对提单的法律调整的有关规定。

Abstract:B/L is the most important document in the international maritime goods transpo rt. The main legal problem is centralized in the carriers responsibi lity in fulfilling the right obligation of B/L. From 1920s to now, the carriers responsibility system has greatly changed and the chang es are mainly reflected by the three international conventions of Hague Rules,Visby Rules and Hamburg Rules. Although our country isnt the c ontracting parties of the three international conventions,yet the Mariti me Law of our country has absorbed and reflected the law adjustment r egulations of B/L.
