《日韩军事情报保护协定》的政策动因及法律保障研究

目的/意义]日本和韩国为在东北亚保持地区大国的优势地位,且能够进一步平衡和消弭同我国间的军事量级,遂共同订立了服务于彼此的军事情报保护协定。研究日韩军事情报保护协定有助于我国把握其政策动因和法律保障,在此基础之上分析其脆弱性,使我国积极采取适时的军事政策和立场予以应对。方法/过程]通过对日本和韩国签署协定的政策历史的回顾并梳理军事情报法律法规,采取建构主义、现实主义以及支配力控制理论等分析并预测其政策不稳定性,并总结出两国法律适用的主要障碍。结果/结论]解读了日韩军事情报保护协定的主要内容,全面总结并分析出其政策和法律缺陷,为我国及时应对日美韩军事联盟在东北亚对我国造成的区域威胁,提供了军事情报政策指导依据与军事情报法律参考。

Research on Policy Motivation and Legal Guarantee in Japan-Korea General Security of Military Information Agreement

Purpose/Significance]Japan and South Korea have signed a military intelligence agreement to maintain a regional power in Northeast Asia and to balance our country's military strength.Studying the military intelligence agreement between Japan and South Korea is helpful for China to grasp its policy motivation and legal guarantee,analyze its vulnerability on this basis,and actively adopt timely military policies and positions to deal with it.Method/Process]Through reviewing the policy history of Japan and South Korea's signing of the agreement and combing the military intelligence laws and regulations,this paper analyzes and predicts the policy instability by means of constructivism,Realism and Power play theory,and summarizes the main obstacles to the application of the laws of the two countries.Results/Conclusion]The main contents of the Japan-South Korea military intelligence agreement are interpreted,and the shortcomings of its policies and laws are comprehensively summarized and analyzed,which will provide the military intelligence policy guidance basis and legal reference for China to deal with the regional threat posed to China by the Japan-US-South Korea military alliance in Northeast Asia in a timely manner.
