论人工智能生成内容的可版权性——以我国著作权法语境中的独创性为中心进行考察

目的/意义]人工智能生成内容的出现,不仅构成了对人类传统创作与阅读活动的冲击,也对著作权法意义上作品认定规则带来挑战。有必要从学理上对人工智能生成内容的可版权性予以明确。方法/过程]以独创性为中心,在阐明这一可版权性的关键概念的基础上,从“独立创作”与“最低限度的创造性”两个角度对人工智能生成内容的独创性予以分析。结果/结论]研究发现,人工智能通过机器学习接触作品的目的是形成算法而非抄袭,从而满足独创性中“独立创作”要求。但是,机器学习的纯粹经验主义,使人工智能无法获取人类创作的先验元素,其生成的内容本质上不具有无限的符号变化空间,“创造性”不足,故而不应被认定为作品。

Analysis on Copyrightability of AI-Generated Content:An Investigation Centered on Originality in the Context of Chinese Copyright Legislation

Purpose/Significance]The emergence of AI-generated content not only poses an impact on human's traditional creation and reading activities,but also brings challenges to the work recognition rules in the sense of Copyright Legislation.It is necessary to clarify the copyright nuture of the AI-generated content.Method/Process]This paper will be centered on originality of the copyright works,and on the basis of clarifying the key concept of copyability,analyzes the originality of the AI-generated content from the perspectives of"independent creation"and"minimal creativity".Result/Conclusion]The research finds that the purpose of Machine Learning is to form algorithms rather than plagiarism,so as to meet the requirements of"independent creation"in originality.However,the pure empiricism of Machine Learning makes it impossible for AI to acquire the transcendental elements of human creation,the AI-generated content does not have infinite symbolic change space in essence,so it is insufficient to meet"minimal creativity".AI-generated content should not be regarded as works In the sense of Copyright Law.
