论解决我国罚金刑执行难问题的对策建议

罚金刑是一种对利欲性犯罪的财产刑，由于其可以避免短期自由刑的各种弊害，因而在我国司法实践中被广泛适用。然而罚金刑在司法实践中面临着难以执行的问题，许多法院为了解决这一问题，采取了“先缴后判”的应对办法。这种偏激的做法受到了法学理论界的广泛批评和质疑。笔者认为．解决我国罚金刑执行难问题的根本出路在于，认真分析我国罚金刑执行难产生的原因，并在此基础上通过借鉴国外相关先进经验，对我国现行罚金刑制度加以改革完善。

On Proposals and Countermeasures for Solving the Difficulty in Carrying out Fine Penalty in Our Country

Fine Penalty is aiming for the crime of longing for private benefits. It is carried out commonly in China＇s justice practice because it may avoid the disadvantages of Short-term Freedom Penalty. However, the fine penalty also has the difficulty of carrying out in its practical use. Many courthouses take out the countermeasure of ＂Pay First and Sentence Next＂ to solve this difficulty. But this measure is criticized and questioned by scholars in law. The author thinks that the basic way of solving this difficulty is to reform and perfect our present Fine Penalty system after analyzing the reasons of the difficulty and leaning the advanced experience in foreign countries.
