| 摘 要： | CEPA的顺利实施，并不能掩盖CEPA的不足，特别是争端解决机制的缺位。基于对CEPA构建争端解决机制必要性与可行性地深入剖析，比较区域性经济组织的仲裁模式和WTO法律化的专家组断案模式在CEPA下的适用。以WTO专家组断案模式为蓝本，并结合CEPA自身的特点，提出以“附件”形式构建CEPA规则取向型专家组断案模式的框架及具体思路。

| Abstract: | The implementation of CEPA cannot conceal its limitations,especially the lack of Dispute Settle Mechanism.Based on the analysis of necessity and the feasibility of the establishment of Dispute Settle System of CEPA,we compare the arbitration mode and the Panels juristical mode.This thesis suggest that we establish the juristical and non-political Panels mode as a form of annex and put forward its framework and detailed regulations. |
