| 摘 要： | 当前,刑事附带民事诉讼中精神损害赔偿在学理解释和司法实践方面存在问题,精神损害赔偿存在立法缺陷.应当完善民事立法、刑事立法,使刑事、刑事诉讼法的规定与民法、民事诉讼舷法的研究协调统一起来,充分保护当事人的合法权益.

| Abstract: | Based on the theoretic interpretation of mental injury reparation in a civil claim annexed to a criminal case and the legislative practice, the article analyses the legislative defects of mental injury reparation and makes a legislative suggestion of mental injury reparation of a civil claim annexed to a criminal. |
