| 摘 要： | 中华人民共和国《合同法》第286条规定的建设工程承包人的优先受偿权属于法定抵押权,承包人实行其法定抵押权前应先经登记;对建设工程款优先受偿的范围及内容宜作具体分析,分别对待。法定抵押权应当优先于约定抵押权和让与担保权。

| Abstract: | According to the Provision 286 of "Contract Law" issued by People's Republic of China,the right of priority for compensation which the contractor has belongs to the legal mortgage right,contractor must register with the proper authorities before carrying out the legal mortgage right.It is advisable to analyze and deal with the sphere and content of priority for constructive compensation.The legal mortgage right must be in advance of contradicted mortgage right and concession guarantee right. |
