| 摘 要： | 以何种分配原则将真伪不明事实的证明义务及不利后果分由各诉讼主体承担是刑事诉讼中非常重要的问题。而一种原则的确立应适当吸收历史的给予，同时充分考虑到各种影响因素。基于此，章评介了国外的证明责任分配学说，分析了影响确定刑事证明责任分配原则之因素，进而提出我国应确立一般和具体这两种刑事证明责任分配原则的设想。 |

| Abstract: | How to distribute the duty on testifying events and to assume the consequences is Very important issue on the criminal procedure. A principle is establised under the conditions that it absorbs the historic aspects and other dismentions. For that, this articles disscussed some ideas on foreign distributions and anglyse the reasons rohieh influences the establishment of responsible principle. |
