| 摘 要： | 分析蒙古族习惯法的源头必须从禁忌入手，元朝的立法司法实践受到蒙古族习惯法的影响仍然十分明显，如元朝的刑罚制度、婚姻继承制度，而且在中国历史上，从来没有一个王朝赋予僧侣如此多的特权，实践中，元朝在处理民事诉讼案件时，广泛运用调解方式。

| Abstract: | If we analyze the origin of Mongolian customary law, we have to start with taboos.In the Yuan dynasty ,the practice of legislation and judicature was obviously affected by Mongolian customary law,for example,penalty, marriage and inheritance systems. In addition,monks have never been given so many privileges by court in the Chinese history.In practice ,mediation was used widely by the Yuan dynasty in hearing the civil cases. |
