| 摘 要： | 因为法律规范本身的规范性、抽象性、静态性、不明确性,如何实现枯燥的法律条文从文本走向活生生的执法实际,需要执法者进行合理解释.通过法律解释为写作起点,分析了从“法无明文授权不行政“的严格法条主义到行政主体拥有广泛行政裁量权的嬗变;法律解释与海关执法行使行政裁量权的暗合;海关执法法律解释的适用以及所对应的行政裁量权的限制等问题.

| Abstract: | For the normative,abstractness,stillness and ambiguity of laws and regulations,so in the process of bringing these boring laws items into practical life,laws administrators need make a reasonable interpretation of them.The article,beginning with the legal interpretation,discusses the transmutation from rigid bookishness of not administrating without clear authorization in laws to administrators having the wide power of executive arbitration,the combination of legal interpretation and customs enforcing the power of executive arbitration,the adaptation of legal interpretation in customs administration and the limit to related power of executive arbitration. |
