Motivation of the Patent System on Innovation

The history of the western patent system's development has showed that patent system plays a great role to promote technical innovation and economical development. The basis that patent system could encourage technical innovation lies in it is the system about defining property. The patent right is individual property, which is an exclusive privilege; therefore the patent system is the best effective innovational institution. The effect of this defining property is that people's innovation ability is greatly encouraged. In the meanwhile of protecting patent rights, this monopolize rights must be limited by law, so that safeguarding social public benefit, and preserving permanent innovational ability of society finally.
