摘    要:承租人的优先购买权问题是优先权制度中的一个方面,优先权作为民事立法所确立的制度由来已久,近年来随着市场经济的进一步发展,特别是我国住房制度的改革、货币化分房的进一步推进,房产交易市场异常活跃,房屋租赁合同和房屋买卖合同应用日渐广泛。其中就承租人的优先购买权行使问题出现了大量的纠纷。在司法实践中,关于承租人的优先购买权问题的规定相对偏少,而且过于原则。本文拟就承租人的优先购买权的概念、特征及其法律依据、行使条件和立法完善作一些初步探索,以期对审判实践有所裨益。

Abstract:Contractor's priority of purchase is one aspect of priority system, which has a long history as civil legislation. In recent years, the market economy furthur develops, the housing system reform and the extension of house allotment in currency pushes forward, and real estate business operates well, so the application of home-rent widnens. As a result, disputes about contractor's priority of purchase come up. In judicial practice, stipulation about that is comparatively less, but over strict. This paper intends to probe into the concept, feauture and law base, and the practice condition for the benifit of judging practice.
