加拿大孤儿作品强制许可制度研究

我国著作权法第三次修订时采取了以加拿大版权法为代表的"强制许可"模式来解决孤儿作品授权利用的困境。尽管两国立法的时代背景有别,但路径选择与基础框架的一致决定了二者在具体规则与运行机制方面具有一定通约性。加拿大孤儿作品强制许可制度的内容与实践对我国富有借鉴意义,其中,"尽力查找""许可费给付"与"对权利人行使请求权予以限制"等核心机制设计,对于立法者如何回应公共图书馆等文化机构对海量作品使用的顾虑与关切尤有启发。

Study on Orphan Works Compulsory License Regime of Canada

The third revision of copyright law in China adopted the compulsory license regime which has been adopted by Canada for almost three decades to deal with orphan works problems.Although legislative background of the two countries is different,the regimes have much commonality in specific rules and operation mechanism determined by the consistency between the path selection and basic framework.The Canadian legislation and practice is enlightening to the very system construction in China.The core mechanisms such as"search with reasonable efforts","payment of license fees"and"limitation of copyright-owners claim"suggest solutions to public libraries’concern over non-commercial massive uses.
