| 摘 要： | 格式条款是否订入合同是认定该条款效力的前提性条件,对格式条款是否订入合同可以从格式条款提供者合理提请注意、相对方了解并接受该条款、格式条款不属于异常条款且不与个别约定条款相抵触三个环节加以判断。

| Abstract: | Determining the standard term as integrate term of a form contract takes a important role in giving judicial regulation on contractual standard terms.To be effective,format clause should meet the following requirements:1.accepted by counterpart;2.not being exceptional clause;3.not contradictory to other clauses. |
