| 摘 要： | 因强制拆迁所引发的社会矛盾已成为一个不可忽略的社会问题。本文从强制拆迁的正义性分析入手,认为我国现有的拆迁制度无论从实体视角还是程序视角均缺乏正义性。对强制拆迁的规范,必须在法治的框架内构建合理的“公共利益”决断机制、国家强制力介入机制和充分补偿机制,从程序到实体的各个环节充分保障被拆迁人的合法权益,以构建一个稳定和谐的社会秩序。

| Abstract: | The contradictions caused by forced building demolition have already become a social concern.After analyzing the justice of the regulations of building demolition,the paper states that forced building demolition is lack of justice in respect of substantiality and procedure.It argues that its reconstruction must be construted under the determinative mechanism of public interests,intervention mechanism of governmental force and sufficient compensation mechanism in order to protect the rights and interests of dwellers. |
