论占有的概念

文章从介绍各个时期民法占有的概念入手，通过对各种占有概念的分析与比较，指出传统上由于历史的局限性，占有以强调对财产的保护为出发点、以确定财产的归属为归宿来研究占有问题，对占有进行理解。而现代民法日益重视财产利用，现代占有的实质是：强调对财产更好地合法利用。因此，应该从如何利用这一角度出发，赋予占有以全新概念，进加强对现代民法占有问题的研究。

On the Concept of Possession

This paper outlines the concept of civil possession in different historical periods and compares various possession concepts.lt points out that the traditional concept of possession,because of historical limitations,merely centred on property protection and ownership while the modern civil possession concept emphasizes the better and legitimate utilization of property.Therefore,modern civil possession should be approached from the perspective of how to better utilize property so as to render a new concept for the possession issue.
