| 摘 要： | 传染病防治失职罪属于渎职罪中的一具体罪名.该罪在犯罪客体、客观方面、主体和主观方面都有自己的特征.在司法认定传染病防治失职罪时,我们要注意新旧刑法的变化和有关的司法解释.同时,我们要对该罪的立法设计和司法解释进行实事求是地评价.

| Abstract: | The crime of breach of duty concerning epidemical prevention and cure is categorized as a specific crime of dereliction of duty. ollege students deemed as a special social group. This crime has some special features in terms of crime object, objective aspect, crime subject and subjective aspect. In the procedure of criminal cognizance of epidemical prevention and cure, we should look sharply at the changes of new and old criminal law and the related judicatory explanation. At the same time, we should also be practical and realistic towards the estimation of lawmaking and judicatory explanation about this crime. |
