| 摘 要： | 保险合同是射悻合同.保险人基于投保人或被保险人告知的有关情况决定是否承保及费率如何.因而,对于如实告知义务的规定也就成了保险法的一项重要内容.我国保险法对告知义务的规定存在着缺陷和不足,文章通过其含义、内容和依据的阐述和分析,希冀对我国保险法中的如实告知义务制度构建有所裨益.

| Abstract: | Insurance contract is a gambling contract. Underwriters decide whether accept insurance and how about insurance premium,basing on what policy-holder or insurants inform.So,it is an important system of insurance law how to prescribe informing obligation.There are some shortcomings and defects about the informing obligation in the Insurance law of our country .The text hope giving some advise to our Insurance law 'legislation by analyzing and expatiating its meaning,content and causation. |
