| 摘 要： | 探望权是修改后的婚姻法确立的一项民事权利,虽然在一定程度上实现了立法的意图,但在行使方面仍然存在一些问题。这既有立法、司法解释方面的原因,也有司法实践操作方面的原因,在分析研究上述问题的基础上,有必要提出改革和完善的建议。

| Abstract: | The visiting rights belong to one of the civil rights that the amended Marriage Law established.Although it has made the intention of legislation become reality to a certain extent,problems still existin practice.The explanation of legislation and judicature could be one of the reasons and the judicial practice could be another as well.On the basis of analyzing and studying the above-mentioned problems,it isnecessary to put forward some suggestions in order to reform and complete them. |
