| 摘 要： | 在复杂的社会生活中,人与人的交往产生分歧与矛盾是难免的,这就必然出现纠纷与诉讼问题。宋代追求儒家的＂无讼＂理想,以客观公正、自愿平等为原则,调处的协约应有法律作为保障等加以解决。宋代政府积极妥善解决协调,化解矛盾,稳定社会秩序,推动了民事诉讼制度的发展,至今值得我们借鉴。

| Abstract: | In the complex social life,difference and contradictory among people is unavoidable.That leads to the dispute and lawsuit question.Song Dynasty pursues the non-suit of Confucianism.They solved problem based on the principle of just,willing and equal,mediatory aggrement which had legal validity,and so on.Song Dynasty government harmonized actively and properly,conciliated conflict,stabilized social order,then developed the system of civil lawsuit.Their experience is worth using for reference up to now. |
