| 摘 要： | 面对日趋激烈的金融竞争，我国城市商业银行处境艰难，而市场化改革是其内在的要求与唯一出路。市场化改革的法律构想主要有：建立民营资本准入制度；提高城市商业银行的资本充足率；强化城市商业银行的治理结构；建立存款保险制度；依法确认城市商业银行的跨区域经营。

| Abstract: | In the increasingly serious financial competition, the urban commercial banks in China are confronted with hard situation. Actually, the reform towards market is their own demand and the only solution. The legal proposals concerning the reform towards market mainly include: to set up the system allowing the invest of civil capital; to improve the sufficiency rate of the capital of the urban commercial banks; to intensify the management structure of the urban commercial banks; to set up the insurance system of deposits; to identify the trans-regional operation of the urban commercial banks. |
