| 摘 要： | 民事诉讼法没有明确民事诉讼的证明标准,司法实践中,人民法院一直以‘客观真实’证明标准审理民事案件。《关于民事诉讼证据的若干规定》实施后,人民法院以‘法律真实’标准审理民事案件。人民检察院的民事审判监督理念应根据民事诉讼证明标准的变化而有所变化,既要坚持‘客观真实’标准,又要尊重‘法律真实’标准。

| Abstract: | Although the civil procedure law does not make any definite legal regulation on the standard of proof,the people's court had tried civil case by the standard of objective truth in practice for a long time.Since the supreme people's court enacted the judicial intepretation on some regulations about civil lawsuit proof,the people 's court began to try civil cases by the standard of legal truth.In the face of the change,the people's procuratorate should not only uphold the standard of "objective truth" but also respect the standard of "legal truth" of evidence rules applicated by the people's courts to try civil cases accurately. |
